Sales Policy for ACUVUE® Brand

VISTAKON® helps promote patient health through the responsible and safe distribution of its contact lenses. ACUVUE® products will only be sold through qualified professionals and retailers that sell only to end users, based on a valid prescription, in compliance with all applicable laws and regulations regarding the sale and dispensing of contact lenses and the ACUVUE® Brand Diagnostic Lens Policy set forth below.

VISTAKON® does not ship its products with labeling materials that permit them to be sold over the counter. Therefore, all qualified professionals and retailers, prior to delivery or shipment of the lenses to the consumer, must comply with all federal and state laws and statutory regulations regarding the sale or furnishing of contact lenses, including prescription verification laws.


VISTAKON® products are warranted against defects in materials and workmanship. If, after opening a factory-sealed blister pack, the lens is found to have a workmanship or material problem, VISTAKON® will replace the lens.

Except for the expressed warranty stated above, VISTAKON® disclaims all warranties, expressed or implied, including any implied warranty of merchantability or fitness for a particular purpose. The expressed warranty and remedy provided are exclusive and in lieu of all other warranties and remedies by law.

The above warranty and remedy extend only to the original purchasers from ACUVUE®, and ACUVUE® expressly denies the right of any other party to incur or assume on behalf of ACUVUE® for special, incidental or consequential damages arising from breach of warranty, breach of contract or any other legal theory; including, but not limited to, damages resulting from loss of profits or revenue, business injury, costs of substitute products or claims of customers.

Why are we replacing UPP?

We are discontinuing UPP in order to renew and continue our commitment to advocate for the doctor-patient relationship and against legislation that threatens to deregulate the industry and undermine patient health.

We introduced UPP in 2014, and today a majority of patients are paying less for their ACUVUE® Brand Contact Lenses than two years ago. Since 2014, there have also been significant legal and legislative challenges to UPP across the country that are distracting our focus on emerging issues that could lead to deregulation of contact lenses. Proponents of deregulation advocate for harmful policies, such as online prescribing of contact lenses and extending contact lens prescription expiration limits. Opposing these efforts requires our undivided attention. 

Our new ACUVUE® Rewards Program replaces UPP and provides similar benefits—affordability, access, and patient retention.
